Tips for Filing a Patent

In early 2021, I had the Idea for my first invention (the RedCat) and I decided to make it a reality–I had no clue how to do it and was quickly overwhelmed by the vastness of the intellectual property (IP) world and how technical the process is.

So…to help you along your journey to the day you file your patent application (the day your protection starts), here’s my “top four” tips for filing a patent:

First, keep your invention close hold.  You will be asking a lot of people for help but be very careful who you discuss the exact details of your invention with.  Only discuss very general details of your invention.  Early on, the exception to this is when you sign the paperwork with your IP law firm.  Later in the process you may need to hire companies to assist with manufacturing.  Make sure you have them sign a non-disclosure agreement before you discuss any details.

Second, make sure your invention works…and don’t be afraid to ask for help.  This sounds obvious but–how do you ‘really’ know it works unless you’ve verified it?  With the help of a few close friends, I learned how to use 3D software and a 3D printer and to test and evaluate a prototype like an engineer.  After 31 prototypes, my working prototype looked nothing like my original idea!

Third, hire a law firm that specializes in patent law.  It will cost you now but you save much more later.  These lawyers are not only licensed to practice but they are also fully accredited engineers–with more schooling than a brain surgeon and decades of experience in the industry.  Hiring a firm was the best decision I made. They cut the process from years to weeks and they helped me put out a much better product.  And if someone infringes on my work, the firm will be there to defend.

Finally, focus on the “claims” section of the patent application.  It holds the precise and legally binding language of the patent and the IP it protects.  To get it right, you must have a very deep understanding of exactly how your invention works and be able to articulate that effectively.  Don’t attempt this on your own…you have the technical knowledge but you need the law firm to help you protect your IP.

The IP process is indeed overwhelming but there’s an army of dedicated people out there that can help you navigate it and get you to the date you file your patent application—the date which the protection starts and you’re no longer in a race to finish first.
